‘No Win, No Fee’
A shout out to those with a possible accident claim in Townsville. Or a work injury claim in Townsville. It’s a common phrase amongst law firms, and frankly it’s the definition of a classic stitch up. It sounds great, doesn’t it? – The possibility of something being free. But I’m here to tell you that it sounds better than it is folks.
This phrase refers to the compensation claim. It basically says that if you don’t win any compensation for your claim, you will not be charged any legal fees. And while that’s 100% true, what people don’t realise is that any sane lawyer won’t take on a compensation claim if your compensation claim isn’t all but guaranteed. It would simply be a waste of time for you. And a whole lot of work for nothing. So what it usually means is, ‘if you have a successful claim, there will be a fee, at the end.’
There’s a lot of cost and time that goes into a successful claim. (And an unsuccessful one!) So it’s sweet that fees are deferred until the end when the money comes in. Frankly, it’s the only way I (and most people) could fund a lawyer in these circumstances. So if the fees are payable at then, it's really just a question of how reasonable the fees are.
