Standard Wills for Couples

Prices

2 Standard Wills cost $1980 (inc gst).

This price includes a free Enduring Power of Attorney (EPA) with each Will.

  • A Standard Will contains a number of clauses that are clear and straightforward. If a Will requires extra clauses to cater for a complex family arrangement, and a number of specific bequests, it will take more time and will cost a little extra.
  • An Enduring Power of Attorney provides for a time when you are unable to make important decisions about your finances or health due to illness, an accident or absence. For example, it would be used to appoint a family member to pay your bills if you are in hospital and unable to this yourself.

When you see the lawyer at the first appointment, they will confirm the price of your Will with you before any work is commenced.

Process

1. Call us to make an appointment with our Wills and Estates Lawyer. In this appointment, you can ask questions and discuss your situation with the lawyer who will advise you. Recommendations will be made by the lawyer. (You may choose to have a Superannuation Binding Death Benefit Nomination form prepared along with your Will and EPA.)

The price to prepare documents will be confirmed. If you wish to proceed, once payment is made to our Trust Account, we will start preparing your documents.

2. A second appointment is arranged for you to come in and sign your Wills and EPAs.


Standard Will for Singles

Prices

A Standard Will costs $1210 (inc gst).

This price includes an Enduring Power of Attorney (EPA) for FREE

Process

If you are over 18, have property, family/loved ones, you should have:

If you have assets (excluding superannuation) that are more than $1 million dollars, you should consider having a Testamentary Trust Will.

Standard Will for a single person – $1,210    

Standard Wills for a couple – $1,980             

Superannuation Binding Death Benefit Nomination

$220 per Industry Fund.

Customised Nomination: $550 - $880 depending on prep time.

If you have a SMSF, a Customised Nomination will need to be prepared. A Customised Nomination requires the lawyer to examine the company/trust documents that have established your SMSF and prepare a Binding Death Benefit Nomination Form that complies with the relevant laws (unlike an industry fund where a form is provided). If 2 are needed (and if a couple and same SMSF) – a fee of $220 applies for the 2nd Nomination.

Enduring Power of Attorney (EPAs)

$220 for a single

$330 for couples (2 EPAs).

    Testamentary Trust Wills  

    The lawyer will confirm price at the first Apmt so there are no surprises. There is a lot to consider when estate planning thoroughly. The information and prices below are guidelines only.

     A 'Usual' Testmentary Trust Will

    Assets over $1m – home, investment property, shares etc and there are no company documents or trust deeds.

    - $2,500 for a Single

    - $3,500 for a Couple

    The price includes a free EPA with each Will.

    We also recommend Binding Super nominations - $220 per industry fund.

     A 'Complex' Testamentary Trust Will 

    Assets over $1m – home, multiple investment properties, shares etc. and there is one company, a trust and possibly a SMSF.

    - from $3,500 for a Single

    - from $4,500 for a Couple

    The price includes a free EPA with each Will.

    We also recommend Binding Super Nominations. 

    If you have multiple entities: More than one Company and Trust; a Business which is a Company with a Shareholder Agreement; Multiple Properties/Assets; A Self-Managed Super Fund – SMSF; Detailed gifts to specific family members; Detailed arrangements for gifts in your blended family.

    Estate Documents
    that everyone should have.

    There are Estate documents that everyone should have. Everyone should have a Will, an Enduring Power of Attorney and a Superannuation Binding Death Benefit Nomination in place.

    Estate planning can be very simple. If you have a lot of property and/or a business or land holding, it will be more complicated. Your Will would be written to reflect this and could be quite lengthy.

    Documents used for estate planning include things like Wills, Enduring Powers of Attorney, Powers of Guardianship, Insurance and Superannuation Nominations and Testamentary Trusts. These documents implement the strategies that are developed as part of an estate planning process. It is important to have a lawyer who is experienced to advise you on what is best for your situation.

    WILLS

    More often than not, a Will is 'Standard'.  Sometimes it can be more complicated, especially when there are particular situations that require specially drafted clauses.  We can advise you about this when you come in to discuss your Will with one of our lawyers and we will give you a quote before we start so you can decide whether to go ahead or not. 

    If you have a Will with a Testamentary Trust included in it, the time spent advising and preparing your Will is significant. The price for a single Testamentary Trust Will ranges between $2500 to $4500 for a single person and between $3500 to $5500 for a couple. The number of entities and property you have, and the complexity of your Trust and the time spent preparing it, determines the price. We can advise you about this when you come in to discuss your Will with one of our lawyers and we will give you a quote before we start, so there are no surprises.

    Review your Will Regularly

    If you have had a major life event since you made your Will (like marriage, divorce, children, deaths, bought a home, etc) you should definitely review your Will.  We recommend that you should review your Will, every 3-5 years.  Make an appointment to discuss this with one of our lawyers. If you decide that changes are not necessary, there is no charge for this appointment.
